    Dealing with legal and financial matters for seniors and special needs individuals can be confusing.  This session is designed to increase your comfort, competence, and confidence in dealing with these important issues.  Topics include:

    •  Legal Issues—Background and updated information on Medicaid, how Medicaid works with long term care, spousal impoverishment and recent changes.
    • Forms of Ownership—Tenancy in Common, Joint Tenancy With Right of Survivorship, Life Estates (Retained and Granted), Partnerships, and Related Issues (Agent v. Co-Ownership, Multiple Party Accounts, In Trust for Accounts, Payable on Death Accounts, and Transferable On Death Accounts)
    • Annuities—Parties to an Annuity (Issuer, Owner, Annuitant, Beneficiary), and Types of Annuities  (Fixed Immediate, Variable Immediate, Fixed Deferred, Variable Deferred, and Equity Indexed)
    • Life Insurance—Issuer, Owner, Insured, Beneficiary, Types of Insurance (Term Insurance), and Cash Value Insurance (Whole Life, Universal Life, and Variable Life)
    • Trusts—Types (Testamentary v. Inter vivos, Revocable, Irrevocable, Special Needs, Mental Health POA, and Spendthrift); IRAs, Mutual Funds, and Custodial Accounts
    • Power of Attorney—Legal Requirements for a valid Power of Attorney; Types of Powers of Attorney (Financial and Healthcare), and  Special Considerations (Gifting and Substitute Agents)
    • Advance Directives—Living Will and Healthcare Power of Attorney
    • Guardianship—Plenary v. Limited, Guardian of the Person, Guardian of the Estate
    • Representative Payee
    • Medical Assistance Estate Recovery—Benefits subject to MAER, and state recovery

    About the Presenter:  Kevin Grebas received his B.S. in Political Science from the University of Scranton and his law degree from the Dickinson School of Law of the Pennsylvania State University. He has provided training for PDA care-managers throughout Pennsylvania and frequently speaks to community groups and professional organizations about legal issues affecting the elderly. Attorney Grebas serves clients from across Northeastern Pennsylvania from the Wilkes-Barre office of the Elder Law Firm of Marshall, Parker & Associates, LLC.
